For developers it means they don’t have to raise finance and buy the land/property first before planning permission is secured, which could take many years. For the landowner, they don’t have to incur some of the fees up front, as these are usually paid at the end once the land is sold. Payment might be made in stages or in one go and understanding how this affects your tax position is important. Given the complexity of these types of agreement it is really important to get up to date and independent legal and tax advice before you enter into one, otherwise you might be exposing yourself or your business to significant tax charges.
